Capital Gains Tax Summary Ireland 2013(資本利得稅部分)

Charge to tax

Capital gains tax (CGT) is charged when a person makes a chargeable gain on the disposal of an asset.
An asset means property in any form including intangible property, such as an option or debt.
disposal includes a part disposal and the deriving of a capital sum from an asset.
CGT is charged on gains arising in a tax year after deducting allowable losses. Gains accruing to a partnership are separately assessed on the individual partners.

Residence(住民)

A person who is resident or ordinarily resident in the Republic of Ireland (ROI) for a tax year chargeable to CGT on his worldwide gains in that tax year.
A person who is neither resident nor ordinarily resident in the ROI, is chargeable on the disposal of ROI:
i. land,
ii. minerals or exploration rights,
iii. branch or agency assets.
A foreign-domiciled person is only chargeable on the disposal of non-ROI to the extent that he remits the proceeds into ROI.


若不為愛爾蘭住民或一般住民,在發生以下之處置情況時需要被課徵資本利得稅:
i. 土地;
ii. 礦物或勘查權;
iii. 部門或代理機關資產。

Capital gains tax rates(資本利得稅稅率)

Since 6 December 2012, the general rate of CGT is 33%.

Charge to tax

Stamp duty is charged on deeds, for example, a transfer, lease or mortgage.
Stamp duty is also charged, in the form of a levy, on insurance premiums, credit cards, and bank cards.


Rates of tax (deeds)

A. Transfer(移轉)

A transfer of land or buildings is charged as follows:
1. non-residential property, at 2%,
2. residential property, at 1% on the first €1,000,000 of consideration, and at 2% on the remainder.
A transfer for less than full value (for example, a gift) is charged on the market value.


1. 非住宅不動產:稅率2%;
2. 住宅不動產:首百萬歐圓稅率為1%,其餘則為2%。
若移轉少於整體價值,則從市場價值中課徵。


B. Lease(租賃)

Stamp duty is charged on both the rent and the premium.

But if the lease relates to a house or apartment, and the annual rent is less than €30,000, the lease is exempt. If the lease is for a term between 35 and 100 years, the rate is 6% of the average annual rent. If the lease is for a term exceeding 100 years, the rate is 12% of the average annual rent.

I. INDIVIDUAL TAXATION(個人稅)

Nonresidents are taxed on their income from Irish sources. Married couples may elect to be taxed separately or jointly.

The tax year in Ireland had been aligned to the calendar year as of January 2002.

非住民之所得需要被課稅。已婚配偶則可選擇採取分別課徵或聯名課徵。

INCOME TAX(所得稅)

Nonresidents are liable to pay taxes on their Irish-sourced income. Taxable income is generally an aggregate of all kinds of income.

The rates that apply to residents may not apply to nonresidents, unless all of the taxpayer’s income is subject to Irish income tax. Allowances, deductions and credits available to residents are not available to nonresidents unless certain conditions are met.

非住民之所得需要被課稅(這裡所指的被課稅所得一般是指各種所得的總合)。

RENTAL INCOME(租金所得)

Rental income is taxed at 20%, withheld by the tenant. The taxpayer has the option to file a return and claim relief for income-generating expenses. Allowable deductions include ground rent, rates, maintenance costs, general repairs, insurance, management fees, service charges, advertising, accounting fees, depreciation (wear and tear), building expenditures, and interest.

租金所得須被課徵20%,對承租人預扣稅項。納稅人可選擇報稅或要求支出減免。可允許扣除項目包括地租、維護成本、一般修繕、保險費用、管理費、服務費、廣告費、帳單費、折舊、大樓運作及利息等。

Stamp duty rates range from 0% to 6% on premiums on leases of land and other real property.

不動產出租之印花稅稅率為1%-12%,並對平均年租金保留進行課徵。其實際稅率之多寡則視乎租賃期的長短。
另外,對土地及其他不動產之租金溢價課徵0%-6%之印花稅。


CAPITAL GAINS(資本利得)

Nonresidents are liable to pay capital gains tax for gains realized from the sale of real estate property in Ireland. Capital gains tax is levied at a flat rate of 30%, effective as of 07 December 2011. Taxable capital gains are generally computed as selling price less acquisition costs, adjusted for inflation, and improvement costs.

非住民具有由於愛爾蘭不動產所賺取之資本利得作為資本利得稅之繳付義務,其固定稅率為30%。資本利得一般是以售賣價格減去取得價格計算得出,並以通膨及增值作修正。

Nonresidents earning capital gains exceeding €500,000 from the sale of Irish property are liable to pay withholding tax at the rate of 15%, which is levied on the selling price/fair market value of the property. This tax is then credited against the nonresident’s capital gains tax liability.

How difficult is the property purchase process in Ireland?

There are no restrictions for foreigners purchasing real property in Ireland and the investment climate is favorable for foreign businesses.

愛爾蘭政府目前並沒有對外籍人士投資房地產設定特別的限制。

Once you find a suitable property, make an offer and engage the services of a solicitor. The offer does not legally bind you to buy. When your offer has been accepted, you may if you wish, arrange for a survey for early detection of potential problems. Your solicitor will then draft the Deed of Conveyance, which is the document that transfers the property into your name. This will be sent to the seller’s solicitor for his approval.

當找到自己滿意的不動產物件,提出開價並尋找代書協助登記事宜。開價要求一旦被接納,買方代書就會準備好移轉契約,再提交予賣方代書以獲同意。

The vendor’s solicitor will then draw up a contract for the sale of the house. Once your solicitor has reviewed this contract and is satisfied with it and to the title of the property, you are now in a position to sign contracts.

賣方代書隨即準備好出售合約,經買方代書審查過後,只要認為條件滿意及確認過其所有權,就可以進行簽約。

At this point you hand over a non-refundable 10% deposit. Estate agents are involved in the transaction until seller signs a contract with a chosen buyer. The conveyancing of the property usually takes 6 to 8 weeks.

這時候須繳付10%之不可退還保證金。不動產經紀人會專注於雙方的交易過程上,直到賣方完成簽約為止。整個移轉過程一般須時6-8個星期。

Stamp duty should be paid now, and then the sale of property is registered at the Land Registry Office or at the Registry of Deeds. Depending on the title to the property this can take up to another six months.

同時,也需要繳付印花稅。之後,相關不動產物件將會被記載到土地登記機關或契約登記機關。整個過程須時可達6個月(時程視乎該不動產所有權類別之不同而有所差別)。

Registration Fees(登記費)

The solicitor will determine the nature of the title to your property. The costs incurred will depend on whether the title is held in the Land Registry or the Registry of Deeds. The Land Registry provides the system of compulsory title registration. The register is conclusive evidence of title to property and any right, privilege, appurtenance or burden appearing thereon. On the other hand, the Registry of Deeds provides the system of voluntary registration for deeds and conveyances. The document filed in the Registry of Deeds is a memorial which is essentially a synopsis of the deed and also other statutory requirements.

Legal Fees(代書手續費)

There is no fixed rate of charges for legal fees in Ireland. Fee for conveyancing work offered by solicitors is negotiable. Some solicitors charge a fixed fee while others charge a percentage of the purchase price, around 1% to 1.5%, plus 23% VAT, is payable on legal fees.

代書手續費的多寡並非固定,而且須與協助移轉程序的代書進行協商。有些代書偏好收取固定費用,也有些代書傾向以不動產取得價格的1%-1.5%(另加23%VAT)作為其代書手續費。

Real Estate Agent’s Fee(仲介費)

Although nominally paid by the seller, real estate agent’s fees are usually included in the asking price, thus, effectively paid by buyers. Buyers pay a separate fee if they acquire the services of an auctioneer to purchase the property on their behalf. Auctioneer’s fee varies from 1% to 3.5% of the selling price, plus 23% VAT.

LEADING TO NATURALIZATION

♦  At the start of the sixth year of permanent residency, the holder of a Cyprus EU Permanent Residency Permit who resides in Cyprus continually for 5 years is given the option to automatically apply for naturalization, that is a Cyprus (European Union) passport.

取得永久居留權開始的前六年,取得歐盟塞普勒斯永久居留許可證的持有者一旦連續5年在塞普勒斯居住五年,將可以擁有自動申請取得歐盟塞普勒斯的國籍,也就是取得該國護照

♦   The Cyprus EU Permanent Residency Permit holder will need to present themselves in Cyprus as part of the initial application for naturalization.

在初次申請歐盟塞普勒斯國籍時將會需要出示他們的永久居留許可證

♦   The applicant must have maintained their financial link with the Republic by maintaining a qualifying investment that was used to grant the initial Cyprus EU Permanent Residency Permit throughout the period of permanent residency.

申請者在一開始取得歐盟塞普勒斯永久居留許可證在永久居留期間,必須要透過一定額度的投資保持在該國有一定的財務連結

♦   Once the procedure is completed, the passport is issued.

一旦申請的程序完成,護照即可發出

♦   The family of this Cyprus passport holder will then apply one year later for each of their passports as dependents of a European National.

♦   Invest a minimum of €300,000 used in any type of investment in Cyprus.

♦   To maintain their status as permanent resident, obligation to visit Cyprus within the first 12 months of acquiring the Cyprus EU Permanent Residency Permit and every subsequent two year period for a minimum stay of one week.

♦   Have a secured annual income of at least €50,000 for a family of 4- Provide the full list of documents, translated in English and certified, required for the Cyprus EU Permanent Residency Permit application together with the completed form M.67 (Application for Immigration Permit).- Not be engage in any work in Cyprus, but is permitted to own a Cyprus limited company as a shareholder.

一個四口的家庭至少要擁有安全的年收入至少5萬歐元,提供完成的文年,翻譯為英文並且要認證,需要歐盟塞普勒斯永久居留許可申請連同填妥的M.67表格(移民許可申請)。可以不用在塞普勒斯工作,但是必須要經許可成為塞普勒斯有限公司的股東

Non EU citizens who have made an investment in Cyprus where its whole value is not less than €300,000 (expected to rise to 380,000 in the very near future) and to 510,000 from 1st January 2013 can have the preferential treatment for immigration Cyprus EU Permanent Residency Permits. The immigration permit is also valid as a permanent permit in Cyprus.
